1. Warranty Provider

Throughout this warranty, “Strictly KB,” “Strictly Kitchen and Bath,” “we,” “us,” and “our” refer to Strictly Kitchen + Bath.

2. Our Commitment

Strictly Kitchen and Bath products are designed and manufactured to provide long-lasting performance. Our sinks are made to last a lifetime under normal residential use when properly installed, maintained, cleaned, handled, and stored.

However, product performance, appearance, and longevity may be affected by conditions outside our control, including installation methods, water quality, environmental exposure, cleaning products, chemical exposure, maintenance, storage, handling, misuse, accidents, and ordinary wear.

This Limited Warranty covers qualifying defects in materials or workmanship only. It does not guarantee that a product will remain free from every cosmetic change, maintenance issue, installation-related problem, or form of damage throughout its useful life.

3. Who Is Covered

This Limited Warranty applies only to the original consumer purchaser of a new qualifying product.

For residential sinks, the Limited Lifetime Warranty remains in effect only while the original consumer purchaser owns the home in which the product was originally installed.

This warranty is not transferable to:

  • A later homeowner;
  • A subsequent purchaser;
  • A tenant;
  • A new property owner;
  • A person who purchases the product used;
  • A person who receives the product through resale, liquidation, auction, or unauthorized transfer; or
  • Any other person who cannot establish that they are the original eligible consumer purchaser.

When a contractor, builder, designer, installer, dealer, or other third party purchases the product on behalf of a homeowner, the homeowner may be recognized as the original consumer purchaser only when the product is properly registered within the required period and the underlying Strictly KB order history can be verified.

4. Where This Warranty Applies

This warranty applies only to qualifying products:

  • Purchased directly from Strictly Kitchen and Bath or an authorized Strictly Kitchen and Bath seller;
  • Purchased and installed within the United States;
  • Used for their intended purpose; and
  • Installed and maintained according to the applicable instructions and generally accepted professional practices.

Products purchased from unauthorized sellers, liquidators, auction websites, unverified marketplace sellers, private individuals, or other unapproved sources may not qualify for warranty coverage.

5. Products Covered

This warranty applies primarily to qualifying Strictly Kitchen and Bath sinks and faucets.

Residential Sink Coverage

Qualifying residential kitchen and bath sinks are covered against defects in materials and workmanship for as long as the original consumer purchaser owns the home in which the sink was originally installed.

This is a Limited Lifetime Warranty, not an unconditional lifetime replacement guarantee.

Residential Faucet Coverage

Qualifying residential kitchen and bath faucets are covered against defects in materials and workmanship for one (1) year from the original documented purchase date.

After the one-year faucet warranty expires, replacement components or service parts may be available for purchase. Availability is not guaranteed and is subject to:

  • Product compatibility;
  • Product discontinuation;
  • Current inventory;
  • Current pricing;
  • Applicable taxes; and
  • Shipping and handling charges.

Purchasing a replacement component does not renew, extend, or restart the original faucet warranty.

Commercial and Non-Residential Coverage

Sinks and faucets installed in commercial, industrial, institutional, hospitality, rental, public, multi-family, builder-display, model-home, or other non-owner-occupied applications are covered for one (1) year from the original documented purchase date, unless a different period is expressly provided in writing by Strictly KB.

6. Accessories Are Not Covered

Unless Strictly KB provides a separate written warranty for a specific item, accessories are not covered under this Limited Warranty.

Accessories and components excluded from warranty coverage include, but are not limited to:

  • Sink grids and bottom racks;
  • Custom sink grids;
  • Strainers;
  • Drain assemblies;
  • Disposal flanges;
  • Cutting boards;
  • Prep boards;
  • Colanders;
  • Strainer bowls;
  • Baskets;
  • Trays;
  • Roll-up drying racks;
  • Soap dispensers;
  • Glass rinsers;
  • Air switches;
  • Air-switch buttons;
  • Springs;
  • Faucet weights;
  • Decorative covers;
  • Mounting clips;
  • Fasteners;
  • Grid feet;
  • Bumper guards;
  • Protective sleeves;
  • Rubber components;
  • Silicone components;
  • Cleaning products; and
  • Other removable, consumable, replaceable, bundled, or separately sold accessories.

Strictly KB may offer an accessory, component, or replacement part for purchase or provide assistance as a gesture of goodwill. Such assistance does not establish warranty coverage or create a warranty for that accessory.

7. What This Warranty Covers

This warranty covers a qualifying defect in materials or workmanship that:

  • Occurs during the applicable warranty period;
  • Exists under normal residential or qualifying commercial use;
  • Is not caused or contributed to by an excluded condition;
  • Can be reasonably verified through documentation, photographs, video, testing, inspection, or other evidence; and
  • Is reported by an eligible original purchaser who has satisfied the applicable purchase-verification and registration requirements.

A defect in materials or workmanship generally means that the product failed to conform to its intended manufacturing specifications because of the way it was manufactured or assembled.

It does not include damage caused after manufacturing by installation, handling, maintenance, cleaning, storage, use, environmental conditions, or third parties.

8. What Strictly KB Will Do

If Strictly KB determines that a covered product contains a qualifying defect in materials or workmanship, Strictly KB will select the remedy it considers appropriate based on the product, defect, availability, age, installation, and circumstances of the claim.

At its option, Strictly KB may:

  1. Provide troubleshooting or care instructions;
  2. Repair the covered product or component;
  3. Provide an approved replacement component;
  4. Replace the product with the same model;
  5. Replace the product with a reasonably comparable model if the original is unavailable or discontinued;
  6. Issue store credit;
  7. Refund some or all of the original product purchase price when repair or replacement is not commercially reasonable; or
  8. Provide another reasonable resolution agreed to in writing.

Strictly KB retains the discretion to determine the appropriate remedy. The customer may not require a particular remedy unless applicable law provides otherwise.

Repair, replacement, store credit, or refund under this warranty is the customer’s exclusive remedy to the maximum extent permitted by law.

9. Replacement Product Variations

A replacement product or component may differ from the original in:

  • Finish;
  • Color;
  • Tone;
  • Texture;
  • Dimensions;
  • Design;
  • Drain placement;
  • Construction;
  • Features;
  • Packaging;
  • Included components; or
  • Country or method of manufacture.

These differences may result from product improvements, manufacturing updates, discontinued models, supplier changes, material availability, or natural variation.

Strictly KB does not guarantee an exact color, finish, grain, tone, texture, weld, polish, or design match, particularly between products made at different times or by different manufacturing processes.

10. Meaning of “Limited Lifetime”

“Limited Lifetime” means that qualifying residential sinks are covered against verified defects in materials or workmanship while the original purchaser owns the home where the sink was originally installed.

It does not mean:

  • Every condition is covered;
  • Every claim will be approved;
  • The product will remain cosmetically unchanged;
  • The product will never require care or maintenance;
  • A replacement will be identical to the original;
  • Accessories are covered for life;
  • Labor or installation is included;
  • Damage caused by another person is covered; or
  • Strictly KB must replace the product whenever damage is reported.

Strictly KB has the right to approve or deny a warranty claim after reasonably reviewing the evidence and determining whether the claimed condition falls within the coverage provided by this policy.

A decision will be based on the applicable warranty terms, available documentation, product condition, installation, maintenance, use, claim history, and other relevant information. Strictly KB will not be obligated to approve a condition that cannot be reasonably verified as a covered manufacturing defect.

11. Conditions Outside Our Control

Although our products are designed for long-term use, we cannot control every condition affecting a product after it is delivered.

Factors outside our control include, but are not limited to:

  • Installation workmanship;
  • Countertop fabrication;
  • Cabinet support;
  • Plumbing configuration;
  • Water pressure;
  • Water temperature;
  • Hard or corrosive water;
  • Mineral content;
  • Drainage;
  • Environmental humidity;
  • Freezing;
  • Excessive heat;
  • Thermal shock;
  • Cleaning habits;
  • Chemicals;
  • Abrasive materials;
  • Food acids;
  • Construction debris;
  • Improper storage;
  • Transportation;
  • Jobsite handling;
  • Impacts;
  • Dropped objects;
  • Unauthorized repairs;
  • Modifications; and
  • Failure to follow care or installation instructions.

Damage arising from these conditions is not considered a defect in materials or workmanship.

12. What Is Not Covered

This Limited Warranty does not cover the following:

Normal Wear and Cosmetic Conditions

  • Ordinary wear and tear;
  • Scratches;
  • Scuffs;
  • Dents;
  • Chips;
  • Marks;
  • Finish wear;
  • Fading;
  • Patina;
  • Oxidation;
  • Tarnishing;
  • Staining;
  • Discoloration;
  • Water spots;
  • Mineral buildup;
  • Etching;
  • Surface deposits;
  • Fingerprints;
  • Heat marks; or
  • Other changes in appearance resulting from use, age, environment, or maintenance.

Natural and Manufacturing Variations

  • Minor variations in dimensions;
  • Variations in color, tone, texture, grain, polish, welds, corners, coatings, or finishes;
  • Handmade or handcrafted variation;
  • Variations between website images, samples, renderings, photographs, and the finished product; or
  • Conditions within reasonable manufacturing tolerances.

Misuse, Neglect, and Improper Care

  • Misuse;
  • Abuse;
  • Neglect;
  • Improper maintenance;
  • Failure to clean or dry the product appropriately;
  • Leaving standing water, food, chemicals, cleaners, or acidic substances on the surface;
  • Use of harsh or unauthorized chemicals;
  • Use of abrasive pads, steel wool, gritty sponges, wire brushes, or abrasive cleaners;
  • Use of drain-opening chemicals;
  • Failure to remove mineral or hard-water buildup; or
  • Failure to follow published care instructions.

Installation and Third-Party Damage

  • Improper installation;
  • Installation that does not follow instructions, specifications, codes, or accepted trade practices;
  • Incorrect cutouts;
  • Insufficient cabinet or countertop support;
  • Plumbing errors;
  • Overtightened or undertightened connections;
  • Damage caused during installation or removal;
  • Damage caused by contractors, plumbers, installers, fabricators, countertop professionals, carriers, movers, or other third parties;
  • Damage to surrounding property; or
  • Failure to inspect the product before installation.

Installation of a visibly damaged or incorrect product may limit or eliminate available warranty remedies when installation caused or increased the resulting loss.

Water and Environmental Conditions

  • Hard water;
  • Corrosive water;
  • High mineral content;
  • Poor water quality;
  • Excessive or insufficient water pressure;
  • Freezing;
  • Excessive heat;
  • Thermal shock;
  • Fire;
  • Flood;
  • Natural disaster;
  • Environmental exposure;
  • Outdoor exposure unless the product is specifically approved for outdoor use; or
  • Conditions inconsistent with the product’s intended use.

Chemicals and Cleaning Products

  • Bleach;
  • Drain cleaner;
  • Chlorine;
  • Acids;
  • Solvents;
  • Caustic chemicals;
  • Construction chemicals;
  • Adhesives;
  • Cement;
  • Grout;
  • Paint;
  • Sealants;
  • Abrasive compounds;
  • Metal polish not approved for the finish; or
  • Any cleaning or maintenance product that damages or alters the surface.

Alterations and Unauthorized Repairs

  • Product modification;
  • Drilling;
  • Cutting;
  • Welding;
  • Grinding;
  • Refinishing;
  • Recoating;
  • Painting;
  • Alteration;
  • Unauthorized repair;
  • Use of incompatible components; or
  • Use of unauthorized replacement parts when the part caused or contributed to the claimed damage.

Transportation, Storage, and Handling

  • Shipping damage not reported under the applicable shipping or damage-claim procedure;
  • Damage caused after delivery;
  • Improper storage;
  • Exposure to weather or construction conditions;
  • Improper packaging;
  • Relocation;
  • Dropping;
  • Impact;
  • Stacking;
  • Excessive weight; or
  • Failure to protect the product before installation.

Unauthorized or Unverified Purchases

  • Products purchased from unauthorized sellers;
  • Products without a valid and verifiable purchase history;
  • Products with altered, incomplete, or fraudulent documentation;
  • Used or previously installed products;
  • Resold products;
  • Counterfeit products;
  • Products purchased through private-party transactions; or
  • Products that cannot be matched to a Strictly KB production, purchase, or distribution record.

Display, Clearance, and As-Is Products

Unless otherwise stated in writing, this warranty does not cover products sold as:

  • As-is;
  • Final sale;
  • Clearance;
  • Open-box;
  • Display;
  • Floor model;
  • Factory second;
  • Scratch-and-dent; or
  • Previously returned merchandise.

Any remaining applicable warranty for such products must be expressly stated in writing at the time of sale.

Custom and Special-Order Products

Custom, modified, made-to-order, and special-order products are covered only for a verified defect in materials or workmanship.

The warranty does not cover:

  • Buyer-approved dimensions;
  • Buyer-supplied measurements;
  • Fit issues caused by inaccurate measurements;
  • Approved specifications;
  • Design preferences;
  • Finish expectations;
  • Color-match expectations;
  • Changes requested after production begins;
  • Handmade variation;
  • Compatibility not expressly confirmed in writing; or
  • A customer’s change of preference.

Custom grids and other custom accessories remain excluded unless a separate written warranty expressly provides otherwise.

Costs and Damages Not Covered

This warranty does not cover:

  • Labor;
  • Plumber charges;
  • Contractor charges;
  • Inspection charges from third parties;
  • Countertop fabrication;
  • Cabinet modification;
  • Plumbing modification;
  • Removal;
  • Demolition;
  • Reinstallation;
  • Refinishing;
  • Disposal;
  • Property restoration;
  • Loss of use;
  • Business interruption;
  • Lost income;
  • Inconvenience;
  • Lodging;
  • Meals;
  • Travel;
  • Damage to countertops, cabinets, walls, flooring, plumbing, or personal property;
  • Expedited shipping;
  • Special handling;
  • White-glove delivery;
  • Liftgate service; or
  • Other incidental or consequential costs.

13. Product Registration

Purchases Directly From Strictly Kitchen and Bath

Products purchased directly from Strictly Kitchen and Bath are generally associated with an existing Strictly KB order history.

Separate registration is not normally required when:

  • The purchaser’s identity can be verified;
  • The order can be located;
  • The purchaser is the original eligible consumer purchaser; and
  • The product and purchase date can be confirmed.

Strictly KB may still request proof of purchase, product information, installation information, photographs, or other documentation during a warranty claim.

Purchases From an Authorized Third Party

Products purchased from an authorized retailer, dealer, distributor, marketplace seller, contractor, builder, installer, designer, or other third party must be registered with Strictly KB within ninety (90) days of the original documented purchase date to qualify for this written Limited Warranty.

The applicable seller is responsible for:

  • Making the warranty information available to the purchaser;
  • Informing the purchaser how to register the product;
  • Providing a valid itemized receipt or invoice;
  • Providing the applicable order number, purchase order number, invoice number, or transaction number; and
  • Providing enough information to connect the customer’s purchase to a valid Strictly KB order or authorized distribution history.

The purchaser is responsible for:

  • Requesting the necessary information from the seller;
  • Completing the registration within ninety days;
  • Submitting accurate information;
  • Retaining the original purchase documents; and
  • Confirming that the registration was successfully submitted.

A seller’s failure to explain the registration requirement does not automatically extend the registration deadline or establish eligibility. A purchaser who did not receive the required information should promptly contact the seller and obtain the necessary documentation before the 90-day registration period expires.

All registration requirements and restrictions apply only to the extent permitted by applicable law.

14. Information Required for Registration

A third-party product registration must include:

  • Original purchaser’s full name;
  • Purchaser’s email address;
  • Purchaser’s telephone number;
  • Purchaser’s mailing address;
  • Installation address, if different;
  • Product model or item number;
  • Product finish;
  • Quantity purchased;
  • Original purchase date;
  • Seller’s business name;
  • Seller’s location or contact information;
  • Original itemized receipt or invoice;
  • Retailer order number;
  • Purchase order number, when applicable;
  • Strictly KB order number, when available;
  • Dealer or distributor invoice number, when applicable;
  • Installation date, if installed; and
  • Any other identifying information reasonably requested by Strictly KB.

Registration must be supported by documentation that allows Strictly KB to verify a valid order history.

15. Registration Approval and Denial

Submitting a registration does not guarantee that the registration will be approved or that a future warranty claim will be covered.

Strictly KB may approve, reject, cancel, or request more information regarding a registration.

A registration may be denied when:

  • It is submitted more than ninety days after the documented purchase date;
  • The product was purchased from an unauthorized or unverifiable seller;
  • No valid Strictly KB order or distribution history can be located;
  • The submitted order number, purchase order, invoice, receipt, or transaction number is invalid or cannot be verified;
  • The documentation is incomplete, altered, inconsistent, misleading, or inaccurate;
  • The product information does not match the purchase record;
  • The purchaser is not the original eligible consumer purchaser;
  • The product was used, resold, previously installed, liquidated, or otherwise transferred;
  • The product was previously registered to another purchaser;
  • The information suggests fraud or misrepresentation; or
  • The registration does not satisfy the conditions of this policy.

Strictly KB may request additional information before approving a registration.

Strictly KB may voluntarily accept a late or incomplete registration when the product, original purchaser, seller, and underlying purchase history can be reliably verified. Any exception is discretionary, applies only to that registration, and does not require Strictly KB to approve another late or incomplete registration.

16. Effect of Registration

Registration:

  • Helps establish the original purchaser;
  • Helps connect a third-party purchase to a Strictly KB order history;
  • Helps confirm the purchase date;
  • May help expedite warranty service; and
  • Allows Strictly KB to provide product or service notifications.

Registration does not:

  • Guarantee approval of a warranty claim;
  • Prove that a reported condition is a manufacturing defect;
  • Extend the warranty period;
  • Restart the warranty period;
  • Transfer the warranty;
  • Create warranty coverage for accessories;
  • Override the exclusions in this policy; or
  • Replace the requirement to provide documentation during a claim.

The applicable warranty period begins on the original documented purchase date, not the registration date, delivery date, or installation date.

17. Warranty Claim Deadline

A warranty claim must be submitted during the applicable warranty period:

  • Residential sinks: While the original purchaser owns the home in which the sink was originally installed;
  • Residential faucets: Within one year of the original documented purchase date; and
  • Commercial or non-residential products: Within one year of the original documented purchase date, unless otherwise stated in writing.

Strictly KB may deny:

  • A faucet claim submitted after the one-year warranty expires;
  • A commercial claim submitted after the applicable period expires;
  • A claim submitted after residential sink coverage has ended;
  • A claim involving a third-party purchase that was not registered within ninety days;
  • A claim that does not contain a verifiable order or purchase history; or
  • A claim submitted after the product was discarded, altered, repaired, refinished, removed, or made unavailable for reasonable inspection without authorization.

18. How to Submit a Warranty Claim

Include the following information:

  1. Original purchaser’s full name;
  2. Current address;
  3. Installation address;
  4. Telephone number;
  5. Email address;
  6. Product model or item number;
  7. Product finish;
  8. Original purchase date;
  9. Installation date;
  10. Seller’s name;
  11. Original order number, purchase order number, invoice number, or receipt;
  12. Proof of purchase;
  13. A detailed description of the claimed defect;
  14. The date the condition was first noticed;
  15. Clear photographs of the complete product;
  16. Close-up photographs of the claimed condition;
  17. Photographs of the surrounding installation;
  18. Video, when requested;
  19. Installer or contractor information, when applicable; and
  20. Any additional information reasonably requested during the investigation.

Failure to provide enough information may delay the claim or prevent Strictly KB from determining whether the condition qualifies for coverage.

19. Preserve the Product and Evidence

Do not discard, return, uninstall, repair, refinish, alter, destroy, or replace the product without written authorization from Strictly KB.

Strictly KB may request:

  • Additional photographs;
  • Video;
  • Measurements;
  • Water-pressure information;
  • Water-quality information;
  • Cleaning-product information;
  • Maintenance history;
  • Installation documents;
  • Installer statements;
  • Plumbing inspection;
  • Return of a component;
  • Return of the product; or
  • Physical inspection.

Strictly KB may deny a claim when the product or relevant evidence is no longer available and the claimed defect cannot be reasonably evaluated.

Do not return a product without receiving written return authorization. Unauthorized returns may be refused and do not constitute an approved claim.

20. Claim Investigation and Determination

All claims are subject to investigation and approval.

Strictly KB may consider:

  • Product age;
  • Applicable warranty period;
  • Registration history;
  • Purchase documentation;
  • Order history;
  • Product condition;
  • Installation;
  • Plumbing;
  • Water quality;
  • Maintenance;
  • Cleaning methods;
  • Storage;
  • Handling;
  • Prior repairs;
  • Modifications;
  • Photographs;
  • Video;
  • Inspection results;
  • Similar product testing;
  • Manufacturing tolerances;
  • Claim history; and
  • Other reasonably relevant evidence.

Strictly KB may deny a claim when:

  • The condition cannot be verified;
  • The reported issue cannot be reasonably reproduced;
  • The evidence does not establish a defect in materials or workmanship;
  • The condition is consistent with normal wear;
  • The evidence indicates negligent care;
  • The evidence indicates improper handling, storage, maintenance, or installation;
  • The damage was caused by a third party;
  • The product was altered or repaired without authorization;
  • The claimed condition falls under an exclusion;
  • The registration requirement was not satisfied;
  • The applicable claim period expired; or
  • The claim information is incomplete, inconsistent, misleading, or unverifiable.

Strictly KB’s internal claim determination does not eliminate any rights the customer may have under applicable law.

21. Good-Faith Assistance for Denied or Uncovered Claims

When a claim is denied or not covered, Strictly KB may voluntarily offer assistance as a gesture of goodwill.

This may include:

  • A replacement part at a reduced price;
  • A replacement product at a reduced price;
  • A comparable product at a reduced price;
  • Store credit;
  • Discounted shipping;
  • Troubleshooting assistance; or
  • Another voluntary accommodation.

A goodwill offer may be considered when:

  • Strictly KB cannot verify or reproduce the claimed defect;
  • The evidence indicates negligent care;
  • The evidence indicates improper handling, storage, installation, or maintenance;
  • The damage is cosmetic;
  • The warranty period has expired;
  • The product or part has been discontinued; or
  • The claim is otherwise excluded.

Any goodwill offer:

  • Is voluntary;
  • Is evaluated individually;
  • Is not guaranteed;
  • Is not an admission that the product was defective;
  • Does not reverse the denial of the claim;
  • Does not create new warranty coverage;
  • Does not extend or restart the original warranty;
  • Does not require Strictly KB to make similar offers in other cases; and
  • May require the customer to pay for the product, parts, taxes, labor, freight, or shipping.

22. Shipping for Approved Claims

When a warranty claim is approved, Strictly KB will provide instructions regarding shipping, return, replacement, or disposal.

Unless otherwise stated in writing:

  • Approved replacement parts will be shipped by standard service within the contiguous United States at Strictly KB’s expense;
  • Approved replacement products may be shipped by standard service within the contiguous United States at Strictly KB’s expense;
  • Expedited, premium, international, white-glove, liftgate, or special-handling services are not included;
  • The customer must return a product only when requested;
  • Return-shipping responsibilities will be communicated during the claim;
  • Strictly KB is not responsible for unauthorized shipping expenses; and
  • Strictly KB is not responsible for costs caused by an incorrect or incomplete shipping address supplied by the customer.

The customer remains responsible for removal, packaging, labor, plumbing, fabrication, countertop work, and reinstallation unless Strictly KB expressly agrees otherwise in writing.

23. Replacement Warranty Period

A replacement product or component does not begin a new warranty period.

Any approved replacement remains covered only for the remainder of the original product’s applicable warranty period, unless Strictly KB provides a different written warranty for the replacement.

24. Limitation of Implied Warranties

TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE APPLICABLE EXPRESS LIMITED WARRANTY PROVIDED FOR THE PRODUCT.

FOR RESIDENTIAL FAUCETS, THIS PERIOD IS ONE (1) YEAR FROM THE ORIGINAL DOCUMENTED PURCHASE DATE. FOR QUALIFYING RESIDENTIAL SINKS, THE APPLICABLE PERIOD IS THE DURATION OF THE EXPRESS LIMITED LIFETIME SINK WARRANTY, SUBJECT TO ALL TERMS, CONDITIONS, LIMITATIONS, AND EXCLUSIONS STATED IN THIS POLICY.

This limitation applies only where it is permitted by applicable law and shall not shorten any minimum implied-warranty period that cannot legally be limited.

Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Nothing in this warranty excludes, restricts, or modifies any implied warranty or consumer right that cannot lawfully be excluded, restricted, or modified.

25. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRICTLY KB SHALL NOT BE LIABLE FOR INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE PURCHASE, DELIVERY, STORAGE, INSTALLATION, USE, REMOVAL, REPAIR, REPLACEMENT, OR INABILITY TO USE A PRODUCT.

TO THE EXTENT PERMITTED BY LAW, EXCLUDED DAMAGES MAY INCLUDE:

  • Labor and service charges;
  • Plumbing expenses;
  • Countertop or cabinet work;
  • Removal or reinstallation expenses;
  • Loss of use;
  • Lost income or profits;
  • Business interruption;
  • Inconvenience; and
  • Damage to surrounding property that is incidental or consequential to a covered or excluded product condition.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRICTLY KB’S AGGREGATE LIABILITY ARISING FROM A PRODUCT CLAIM SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

THESE EXCLUSIONS AND LIMITATIONS DO NOT APPLY TO:

  • Personal injury or death to the extent liability cannot legally be limited;
  • Gross negligence or willful misconduct by Strictly KB;
  • Fraud or fraudulent misrepresentation by Strictly KB;
  • Rights or remedies provided by an applicable consumer-protection statute that cannot legally be waived;
  • Court costs, attorneys’ fees, or other relief that a court is expressly authorized to award under applicable law; or
  • Any other liability that cannot lawfully be excluded or limited.

Nothing in this section prevents a consumer from pursuing remedies available under applicable law if an exclusive or limited remedy is determined to have failed of its essential purpose.

Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

26. No Unauthorized Modification of This Warranty

No retailer, dealer, distributor, contractor, builder, installer, designer, independent sales representative, marketplace seller, or other third party is authorized to modify, expand, extend, or make additional promises under this Limited Warranty on behalf of Strictly KB.

No employee or representative is authorized to modify this Limited Warranty unless the modification is made in writing and approved by a duly authorized representative of Strictly KB.

Unauthorized oral statements, recommendations, opinions, or representations made by third parties do not modify this Limited Warranty.

Nothing in this section is intended to disclaim or invalidate an express warranty or legally enforceable factual representation created by Strictly KB that cannot lawfully be disclaimed.

27. Opportunity to Investigate and Resolve Claims

Strictly KB does not currently require consumers to participate in a formal informal-dispute-settlement mechanism under 16 C.F.R. Part 703 before exercising rights available under applicable law.

Before pursuing a legal remedy concerning an alleged breach of warranty, the consumer must provide Strictly KB with notice of the claim and a reasonable opportunity to inspect, investigate, and, when applicable, cure the alleged failure, as permitted or required by law.

Customers are encouraged to contact Strictly KB directly so that the company has a reasonable opportunity to review the product, supporting documentation, installation conditions, and requested resolution.

Nothing in this section requires a consumer to waive any right or participate in a dispute-resolution process that has not been established in accordance with applicable law.

28. Severability

If any provision of this Limited Warranty is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted, narrowed, or limited only to the minimum extent necessary to make it enforceable where permitted.

The remaining provisions shall continue in effect to the maximum extent permitted by applicable law.

29. Applicable Law

This Limited Warranty is governed by applicable federal law and by the state law that legally applies to the purchase, installation, consumer, and warranty claim.

Nothing in this Limited Warranty is intended to deprive a consumer of mandatory rights or remedies provided by the law of a state or jurisdiction that cannot legally be waived or restricted by contract.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
